1. Definitions

    Promoter means Tribal Tipping Pty Ltd, Suite 2, 85 William Street, Darlinghurst, Sydney NSW 2010; ABN: 41 100 582 045;
    Promotion means a sports tipping competition conducted for any season of matches of any code published on the web site within which the winning entries are based on the results of matches at the conclusion of the codes season, including any finals series;
    Round means a group of matches conducted as part of the code's season of matches;
    Website means the website of the Promoter www.tribaltipping.com.au.
    Score means the awarding of points to an Entrant for correct selection of match results as defined by the web site;
    Code means the sequence of matches of the sporting code;
    Match means a single game played by 2 teams of the same code within a season;
    Entrant means an individual who is eligible to partake in the Promotion and who registers to take part in the Promotion;
    Results means the final scores of the Matches as officially determined by the relevant Code in accordance with the rules of that Code following the completion of a Round;
    Season means a sequence of matches for a code comprising of a home and away games.

  2. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions and the Website Terms of Use. In the event of any inconsistency, these Terms and Conditions shall prevail. The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.

  3. Entry is open to Australian residents and non-Australian residents, except where prohibited. Employees of the Promoter and agencies associated with this Promotion and their immediate family are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who in the opinion of the Promoter tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  5. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant

  6. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

  7. To enter any Promotion, entrants must either (a) complete the competition registration form on the Tribal Tipping website, read these conditions and agree to be bound by these terms and conditions. Entrants must select a valid username and password at the time of registration or (b) login to the Tribal Tipping Web Site with a Username and Password set up as part of a previous registration.

  8. Entrants must enter their username and password each time they access the Competition section of the Tribal Tipping website. Entrants must select:

    - the winning team for each match in a Round and any matches they believe will be drawn before the Tip cut-off deadline for the Round in question.

  9. Only one registration per an entrant (and per an email address) will be accepted. If invited to enter a particular league, entrants may enter their details to join that league during the registration process. Alternatively they can create up to three private or public leagues and invite others to join. If they do not select a league, entrants will automatically be entered into a public league.

  10. During registration entrants may refer the promotion to their friends via email using the Refer-a-Friend facility on the Website. If an entrant refers a friend, they warrant that they have obtained their friend's consent to do so prior to sending the email. The entrant indemnifies the Promoter against any claims by any third party for the entrant's failure to do so.

  11. The Promoter's decisions in relation to all aspects of this Promotion is final and no correspondence will entered into, including decisions in relation to the number of points achieved or rankings are final and nor correspondence will be entered into.

  12. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid. Entries containing inappropriate, offensive, derogatory or defamatory content, as determined by the Promoter will deemed invalid and may be removed from display.

  13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any entrant;

  14. Any cost associated with accessing the promotional website is the entrant's responsibility;

  15. To determine the results in each round, Entrants will be ranked relative to the following hierarchy of rules:

    (i) By their score, where the highest score has the highest ranking
    (ii) If Entrants are found to tie in (i) above, the Entrant who registered 1st with the Promoter for any code will be awarded the higher rank.

  16. The end of Season rankings for each Code will be determined:

    (i) By the Entrant's total points score for all Rounds of the Promotion
    (ii) If (i) to fails to determine the final places, the places will be determined based on time of registration with the Promoter with the earliest registration for any code ranking higher.

  17. How Points are determined

    Points will be awarded to each entrant in each Round after they have registered in accordance with the point rules selected by the competitions administrator. The options available to the administrator are shown below

    • Correct Tip
      1 to 10 Points
    • Incorrect Tip
      0 Points
    • Drawn Match
      1 to 10 points Point
    • Bonus points for tipping all matches within a round
      1 to 10 points
    • No tips entered for a given match within a round
      The lowest score of all entrants in your competition, for the round no tips where entered, minus 1 point.
    • No tip entered for some matches within a round
      0 points

  19. The Promotor offers no Prizes for any of the Promotions run on the Web Site. If a Prize is offered as Part of any Promotion this is offered by the Administrator of that competition whose sole responsibility it is to honour the awarding of any prizes at the conclusion of the Competition.
